RELEASE, WAIVER, INDEMNITY
AND ASSUMPTION OF RISK
(hereinafter referred to as the “Release Agreement”)

BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT PLEASE READ CAREFULLY!

In consideration of Denver Film (defined below) agreeing to the undersigned party’s participation in Denver Film Festival VR/Immersive Activities and permitting use of their services, equipment and other facilities, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, the undersigned (“I”, “me”, “myself”) hereby agrees as follows:

1. Definitions. In this Release Agreement, the term “Denver Film Festival VR/Immersive Activities” shall include but is not limited to: utilizing Virtual Reality (VR) equipment, participation in an immersive experience, observing the use of a VR headset, and all activities, services, and use of facilities and equipment either provided by or arranged by Denver Film including orientation and instructional sessions. The term “Denver Film” refers to Denver Film Festival VR/Immersive Activities (owned and/or operated by the Denver Film Festival), the Denver Film Society, a Colorado nonprofit organization, any of their affiliated organizations and entities, each of their respective insurance carriers, agents, employees, volunteers, contractors, representatives, assignees, officers, and board members.

2. Assumption of Risk. I am aware that participation in Denver Film Festival VR/Immersive Activities as defined in this agreement, involves certain risks, dangers and hazards. These may include, but are not limited to: falls to the ground, impacts with other people, impacts with walls, the ground or other structures and equipment, entanglement, other injuries resulting from participating or observing, equipment failure, the negligence of other persons; and negligence on the part of Denver Film.

3. Waiver and Release. I voluntarily assume all risks, whether or not described herein, known or unknown, inherent or otherwise, associated with the Denver Film Festival VR/Immersive Activities. I hereby waive any and all claims against Denver Film arising out of or related to the Denver Film Festival VR/Immersive Activities, and I agree for myself, all of my family, our successors, heirs, personal representatives, and assigns, to release Denver Film from liability, claims, demands, and any causes of action arising out of or related to the foregoing. I intend this waiver and release of liability to be effective whether or not any loss, damage, injury, or death results from negligence or statutory violations.

4. Covenant Not to Sue. I agree for myself, all of my family, and our successors, heirs, personal representatives, executors, administrators, and assigns not to initiate any lawsuit, court action, other legal proceeding or any claim on any basis, including but not limited to claims of negligence, negligence per se, premises liability, wrongful death, breach of contract, or breach of warranty, against Denver Film, nor join or assist in the prosecution of any claim which anyone may have, on account of injuries, death, losses or damages I or others sustain in connection with the Denver Film Festival VR/Immersive Activities.

5. Indemnity. I agree for myself, all of my family, and our successors, heirs, personal representatives and assigns to indemnify and hold harmless Denver Film from and for any sums, costs or expenses (including attorneys’ fees) Denver Film incurs or pays to any person (including me or my insurers) in connection with any accident, injury, death, loss or damage I or others sustain in connection with Denver Film Festival VR/Immersive Activities.

6. Miscellaneous. In the event that I file a lawsuit against Denver Film, I agree to do so solely in the State of Colorado, and I further agree that the substantive law of that State shall apply in that action without regard to the conflict of law rules of that State. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. I agree to follow the rules set forth by Denver Film Festival VR/Immersive Activities and I agree to pay for any damages incurred by Denver Film through non-compliance of those rules by myself or the underage participant I am authorizing.

UNDERAGE AUTHORIZATION

I authorize (Underage Participant) to engage in Denver Film Festival VR/Immersive Activities and on my own behalf and on behalf of the participant, I hereby agree to the release of liability, waiver of claims, assumption of risks and responsibility for compliance with rules described in this Release Agreement.
